MavenRaven Posted June 1, 2024 Posted June 1, 2024 Long story short, can I use the DCS mission music as ambient background for a video? I want to make a highlight/summary of a SP campaign, thought the module music would be a good choice for the background / bit of intro, but I don't want to misuse the material. Any insights on this?

My guess here is that you should contact ED directly (maybe contact @BIGNEWY to get in contact with the right people). You definitely need the OK of the license owner of the music (which may or may not be ED), else you are risking a DCMA strike when you publish the video. And even if the rights are freely available, it is always better (and more respectful of the artists) to make sure that you can publish and have the IP owners acknowledge that. It would be heartbreaking if you pour your heart into a project, create a terrific and popular video only to become embroiled in an IP dispute. So, great start to ask here, I'm really looking forward to seeing the answer. Edited June 1, 2024 by cfrag
Johnny Dioxin Posted June 1, 2024 Posted June 1, 2024 That would be a bit of a joke as ED have one of the biggest download libraries full of pirated music in the User Files section. Rig: Asus TUF GAMING B650-PLUS; Ryzen 7800X3D ; 64GB DDR5 5600; RTX 4080; VPC T50 CM2 HOTAS; Pimax Crystal Light I'm learning to fly - but I ain't got wings With my head in VR - it's the next best thing!

Uh, two wrongs do not make a right. Also, not all countries have the same legal framework. I don't know about Russia (where ED's servers are located), but here in Switzerland, unauthorized downloads is legal for individual consumption, as every citizen in Switzerland pays a fee on storage for this purpose. So individual download and consumption of files is OK, but using other people's IP to create new content isn't unless you own the rights or have the OK of the owner. Now, I really don't like the fact that so much protected stuff in on ED's servers, and it makes me feel queasy. And yet, simply because they operate in a grey zone will not protect if you do likewise. Meaning: if you use the music from DCS in your video without securing the rights, and the IP owner enforces their rights, it's not a valid defense to point to ED and say "but hey look, they are just as bad". Make sure you can defend your work, don't rely on other people being equally careless.

And ED can always strike me down like you said. If I keep the files I can always replace the track. Wanted to reach out and be polite first though.

If ED simply licensed the music that can be some individual (an artist perhaps) or - worst case - a company that is specialized in making money that way. If you live in a litigious country (e.g. USA), double-check that you have the rights. 51 minutes ago, MavenRaven said: Wanted to reach out and be polite first though.
