Question about ACL mode on CASEs

Hello folks how r u? merry christmas and happy new years in a few days

I would like to know if the ACL can be use even in case 1 or 2 or in cavok day like ICLS and TACAN do, I mean if i need it, can i use it or its only available on case 3 condition? another one, it's mandatory to ATC comms to ACL takes alive?

On deck te ACL state is ACL1 after test but in  flight con case 1 or 2 chance tu TILT or i am doing something wrong?

No, ACLS works only with Case III conditions.
Yes, you need to communicate with Marshal.
