Are 3rd Party developers allowed to make FC3 style aircraft?

maybe they're "allowed to" but nobody is planning it

 

and it was my impression that ED was planning on upgrading all of the fc3 aircraft up to the DCS standard..

As I said, in another similar thread, the problem with making an FC level aircraft is that, at least currently, it seems that an SFM is no longer considered satisfactory. Even without the ASM the advanced flight model development time makes for a much more expensive product to produce and it might take just as long as the development of a full 'DCS level' aircraft.
