Military Assets for DCS by Currenthill
Oban replied to currenthill's topic in Static/AI Mods for DCS World
Don't suppose you've made a FAB-500 glide bomb by any chance ? -
LOL... Because you don't hear or see behind the scenes, and between lawyers, your perception is that there's a lack of desire... This isn't a playground spat, where it's having a fight one day and back in the classroom the next day, and by the follow on day, they're back to being best friends. Clearly you've never dealt with corporate lawyers !! The entertainmant value in this thread as to how people seem to think that their knowledge and understanding of the way that things should be , compared to the way things are is mindblowing.

That looks pretty awesome !!

It will be resolved when both parties agree on a solution, you're asking an ambigious question that not one single person in this thread can answer, there's no timeline for such cases, that's down to lawyers and the various players involved. It's like asking when the Aviastorm Tornado will be released... nobody can answer that, and the very people who constantly post "hurry up and release now" are normally the forst ones to complain about the module not being up to their standards. Neither Big Newy, or Nineline are in a position to offer time lines when this specific situation will be resolved, it's time some folks here understood this.
-
So many lawyers here it's hard to keep up with it all.
-
The F15E isn't dead, how many times do people have to be told? If it's not dead, then you don't get a full refund. As it stands, the situation does not deem a full refund, irrespective of what right you may think you have.

I had the IRIS F15E for FSX, it wasn't bad, also had the superbug. I thought the same, as Razbam had a good Harrier GR7/9 for FSX, which would have been awesome to see in DCS, I never understood why it was never considered. Most of the animations would be there, maybe textures would have needed to be updated to DCS standards. Actually RB had a decent A7D/E/P as well..

Totally agree, the burden of proof always lies within the accuser, that being said, IF it all goes to a full on court hearing, which could be several months, or even longer, if that accusation was found to be false, then ED are finished, and instead of 3 modules that are currently effected, the entire collection and platform will vanish, along with any credibility within the community. IF the accusations have merit, then... well I'm sure the picture painted for Razbam won't be pretty either. It's a mess of epic proportions.
-
which is why we're never going to hear anything disclosed on these forums, everything will come out oce it goes to court, IF it actually gets that far.. That being said, both parties are being tried through platforms like this, facebook, and youtube etc which is social media. Which is why I've constantly said leave it to the legal representatives to resolve, and not social media kangaroo courts, who are not privy to all the information
-
That saying "Innocent before guilty " was correct in the past, however these days not so much, trial by social media put paid to that, and it's more about "you're guilty, now prove your innosense !!
-
2 weeks !! Big Newy has already said that there's a backlog for the refunds
-
There's been umpteen posts to state that both parties are working towards a resolution, neither party has opted to pull the plug, considering it's all going through lawyers, not sure what you're expecting.
-
Way to go to twist the narrative.. context is everything.

Hats off to BigNewy and Nineline here for allowing this thread to continue, I think many forget they're also more than likely customers too, owning razbam products, and in the same boat as everyone else. Cool heads need to prevail, this isn't going to be resolved as quick as most would like, and it sure as there's shyt in a dog not worth getting stressed out over something that's not in anyones control here.
-
How many times do you have to be informed that there's more than likely still contractual obligations between both parties that are still in place, that prevents one party removing them ? Until a resolution comes around, it's still business as usual, just because you don't agree with it, doesn't mean that ED has to comply with it. There's a lot of sentiment running here, and understandably so, but there's also a lot of self entitlement kicking around too, both parties are commited to resolving this issue, nothing has changed there.

Polychop lost so much faith, they just went and released their Kiowa, heatblur also lost so much faith, they decided to launch their Phantom, neither of which were early release modules either... so which other 3rd party devs are you referring to, and obviously will have a public statement from them to support such claims? So much hyperbole and not enough plates from which to eat it from !!
-
You're not listening really are you ? It's in the hands of legal representatives, and they're not likely to offer up any information until a settlement/agreement has been signed and agreed upon. I'm also a customer, but don't feel like a needy one, I am quite happy to let things happen behind closed doors, and in the meantime carry on flying the F15E, and AV8B whilst I can, and will continue to do so right up until the 11th hour... patience is a virtue

I think you're looking at the wrong person for making such statements, any sort of refunds would need to be authorised through Eagle Dynamics management, more than likely from Nick Grey himself, and I honestly don't think he would make such a statement whilst negotiations are allegedly still ongoing. I believe there's nothing stopping you from requesting a refund through the support page as it is, as quite a few people have had their request for refund granted according tp several facebook groups
-
Now this made me laugh!!
-
Has there been any change in the stance from the CEO that they have no intention in abandoning their product then?
-
Oh it's been fairly obvious as to which side of the fence you're on, and where your allegiances lie, and there's no problems with that. It's commendable that you're more concerned about those behind the scenes at Razbam rather than the consumers, the way I see it, both have lost out, as for the employees, the moral dillema for them is walking out of a company that's been unable to pay them, and risk losing not getting paid at all, or staying put, and still not getting paid, a tough choice. I do see your point and where you're coming from, personally I will wait for the lawyers to hash this out, but thats possibly going to take a considerable amount of time, and in the meantime, that doesn't help Razbam employees, I highly doubt they can sustain several more months without facing liquidation or bankruptcy.. and they will cease to be, and that's the last thing employees, clients or customers want. It's a shyt show, and the relationship between both parties will never be the same again, and more than likely untenable, no amount of refunds will help the Razbam employees in this case.

That's not what I said, and well you know it, I have stated multiple times, that all of this should have been done through legal representatives, and not thrown into the public, and holding them all to ransome, you may think that's an acceptable strategy, I don't. Are you privy to the terms and conditions of when payments will be made and to the invoicing procedures between Razbam and Eagle Dynamics? Are you privy to all the communications in that 10 month period between Razbam Finance department and Eagle Dynamics Finance department ? Are you privy to the emails between Razbam Finance requesting payment and the submitted invoices as per the terms and conditions ? Are you privy to the meeting between Razbam stakeholders as to how they're going to proceed with receiving their funds and the passing of the decision to go through legal channels Are you privy to the meeting between Razbam CEO/Finance Department and their legal representatives in which to raise the issue through legal matters? Are you privy to the meeting between all Razbam employees in which they all agreed that going public and creating a shytstorm ? Are you privy to the alleged dispute over IP rights ? Are you privy to the possibility of NDA's between both parties ? My guess is the answer is no, you have no real clue, you're not in any loop, nor in a position to know the entire story, you're in the dark as much as the rest of us, and you're venting. That is your prerogative, as a customer, it's your right. I have been in a position within a company where it took over a year to get invoices paid by a client, when it should have been a matter of 90 days max as per their contractual terms and conditions, of which I wrote, even having meetings with their CEO to try and resolve outstanding invoices, and they still dragged their heels.. Regardless of the non payment Razbam should have had contingencies in place for paying their employees, and all of them should have had clauses in their terms and conditions as to which they'd have protections in place for such issues, how many razbam employees went public about not getting paid for 10 months? How many Razbam employees sought legal advice as they'd not received a salary in 10 months? Nobody starts a project and expects a deferred payment with no explanation as to why it's not forthcoming, when the project is released, albeit in early access... Again, not one person venting here has access to the terms and conditions. ED wouldn't withold payment of invoice without probable cause, and just reason, until that reason gets made public, which is highly unlikely, then the shytshow will keep rolling on.

Yes he's correct, Ron opted to hold his module owners to ransom, good faith works both ways too. Razbam should have gone through their legal team and exhausted all resources instead of shafting every single Razbam module owner to get what he wanted, classy move on his part... said nobody ever. Not one person here knows what the terms and conditions are/were between ED and Razbam, that's down to them to negotiate, but going on a rant on public platform rarely works well for the rantee, the road to hell is paved with good intention, that being said Razbam cares not a jot about the customers who own their models if they're threatening to abondon all their products entirely , they'll be totally finished as a 3d developer. If they cared, they'd have considered the wider consequences. For all those demanding that ED stop selling Razbam products, it's not that simple, why not just disable all current razbam products right now if Razbam are not going to support the products anylonger ... Razbam have not put out a statement to say they're closing down, and that there will never be updates again, all they've stated is that until the legal issues have been resolved, then they're not going to update their products. Have they terminated all the contracts of all their current staff, told all their coders they're closing the door for good? No they have not, they want this issue to be fixed as much as anyone else, is it a shyt show? for sure it is, is there going to be a loser? highly likely, at the moment the consumer is the one losing out on updates, that's all, nothing else has been set in stone. All Razbam modules are still functioning, and will continue to function until either party make a decision that will end it all, and that could be months away, even longer.
